Socially and politically significant Muslim communities are posing a challenge to the public spheres of Western Europe: can public reason in a liberal democracy be so conceived as to accommodate the religious reasons of Muslims and other religiously motivated citizens? This question, often discussed from the perspective either of political philosophy or of particular religious traditions, is addressed here instead by drawing on the theory and practice of inter-religious dialogue. The dialogue movement known as ‘scriptural reasoning’ is analysed for its (...) potential to provide a way of conceptualising the nature of reasoning in the public sphere. ‘Reasoning with texts’, it is argued, is a way of describing much of the reasoning that takes place within the public sphere and not just religious reasoning. This approach to understanding public reasoning is established through a combination of example and theory. A model of communicative hermeneutics as public reason based on an textual rationality is proposed. As well as providing space for textually based religious arguments, this textual imagination can be situated alongside and complement postmodern developments of Jürgen Habermas’s conception of the public sphere. Whilst this approach to reasoning in the public sphere initially appears very different from the classic statement of the idea of public reason in John Rawls’s political liberalism, it is shown to have significant continuity with Rawls’s theory when this is viewed through the lens of the Supreme Court as exemplar of public reason. This highest level of public reason involving legislation is also a form of reasoning with texts. But in order for religious and more popular levels of public discourse and deliberation to impact on the political and legislative processes, these too must be conceived as modes of reasoning having some continuity with higher levels of public reasoning. Contemporary infectious disease surveillance systems aim to employ the speed and scope of big data in an attempt to provide global health security. Both shifts - the perception of health problems through the framework of global health security and the corresponding technological approaches – imply epistemological changes, methodological ambivalences as well as manifold societal effects. Bringing current findings from social sciences and public health praxis into a dialogue, this conversation style contribution points out several broader implications of changing disease surveillance. The conversation covers epidemiological issues such as the shift from expert knowledge to algorithmic knowledge, the securitization of global health, and the construction of new kinds of threats. Throughout the COVID-19 pandemic, the concept of solidarity has been invoked frequently. Much interest has centred around how citizens and communities support one another during times of uncertainty. Yet, empirical research which accounts and understands citizen’s views on pandemic solidarity, or their actual practices has remained limited. Drawing upon the analysis of data from 35 qualitative interviews, this article investigates how residents in England and Scotland enacted, understood, or criticised (the lack of) solidarity during the first national lockdown in the (...) United Kingdom in April 2020—at a time when media celebrated solidarity as being at an all-time high. It finds that although solidarity was practiced by some people, the perceived lack of solidarity was just as pronounced. We conclude that despite frequent mobilisations of solidarity by policy makers and other public actors, actual practices of solidarity are poorly understood—despite the importance of solidarity for public health and policy. The theory I present and defend in this paper—what I term the art type theory— holds that something is a work of art iff it belongs to an established art type. Something is an established art type, in turn, either because its paradigmatic instances standardly satisfy eight art-making conditions, or because the art world has seen fit to enfranchise it as such. It follows that the art status of certain objects is independent of what any individual or culture might say (...) about it, while the art status of others fundamentally depends on the judgment of the art world. Because of the theory's quasi-institutional component, I conclude by defending it against four objections that have been raised against institutional definitions. (shrink)

In critical thinking courses, informal fallacies are often best taught through using myriad examples that illustrate the subtle differences between the different fallacies. However, since a heavy reliance can become tedious for students and instructors, one challenge that teaching a critical thinking course involves is striking an appropriate balance between presenting too many and too few examples. This paper presents a way to introduce informal fallacies through an acted-out dialogue, while reserving more traditional examples for homework or in-class discussion.

One of the more striking aspects of Adam Smith's moral theory is the degree to which it depends on and appeals to aesthetic norms. By considering what Smith says about judgments of propriety – the foundational type of judgment in his system – and by tying what he says in The Theory of Moral Sentiments to certain of his other writings, I argue that Smith ultimately defends an aesthetic morality. Among the challenges that any aesthetic morality faces is that it (...) seems to entail moral relativism. This problem is magnified by Smith's reliance on the judgments of the impartial spectator, which also seems to make his theory more vulnerable to a Euthyphro-type objection. I suggest that Smith can potentially get around these problems, given his presumption of aesthetic naturalism. While there is certainly some variation in our aesthetic judgments, Smith claims that we naturally find certain actions and sentiments odious, while others we find agreeable. The reason, he argues, is that any society that judged otherwise would not survive. (shrink)

Abstract Disagreement persists concerning whether aesthetic properties supervene on non-aesthetic properties. This issue is complicated by the fact that the notion of an aesthetic property is itself contentious. In this paper, I begin by identifying three conditions that arguably characterize a large number of aesthetic properties. After defending aesthetic supervenience against a number of objections, I argue that a strong version of the supervenience thesis applies to those properties that satisfy my initial conditions.

Confidentiality of health information is increasingly relevant in the era of electronic medical records. We discuss the case of a hospitalized patient who requested a neurology consultation for an episode he described as an “LSD-like” (Lysergic acid diethylamide) flashback. The patient expressed concern that the episode was a residual effect of past drug use, but subsequently requested that his drug use not be documented. Involved in a custody battle, he feared that if his records were released to the court he (...) could lose custody of his children. Ethical concerns arose with regards to the physician’s competing obligations with a duty to record information accurately and honestly, respect patient autonomy, and maintain patient confidentiality. We discuss the decision of the team to document the patient’s drug use by arguing that the obligation to maintain confidentiality did not supersede the primary role of the medical record as a complete and accurate account, which cannot be altered at a patient’s behest. We start with a simple question: If you could reinvent higher education for the 21st century, what should it look like? We began by taking a hard look at problems in traditional higher education, and innovated in many ways to address these problems head-on: We have created a new curriculum, focusing on what we call "practical knowledge"; we have developed new pedagogy, based on the science of learning; we have used technology in novel ways, to deliver small seminars in real (...) time; and we have developed an international hybrid residential model, where students take classes on the computer but live together, rotating through seven different cities around the world. The Minerva Schools at the Keck Graduate Institute (KGI) are the first university experience built for the twenty-first century. In setting up this program, we have had to confront the realities of all aspects of higher education--from admissions, through instruction, to career development, to establishing a reputation. The goal of this book is to provide an evidence-based model for a future of higher education. We have learned a lot about how to reshape all facets of higher education and this book summarizes what we have learned. We hope that our innovations can serve as models of "best practices"--and thereby have a major influence on higher education writ large. (shrink)

The past two decades have seen an outpouring of work in legal theory that is self-consciously critical of aspects of American law and the institutions of the liberal state. In this lively volume, eminent scholars in philosophy, law, and political science respond to this recent scholarship by exploring what constitutes a "radical" critique of the law, examining such theories as critical legal studies, feminist theory and theories of "difference," and critical race theory. The authors consider whether the critiques advanced in (...) recent legal theory can truly be called radical and what form a radical critique of American law should take. Writing at the cutting edge of the critique of critical legal theory, they offer insights first on critical legal scholarship, then on feminist political and legal theory. A third group of contributions questions the radicalness of these approaches in light of their failure to challenge fundamental aspects of liberalism, while a final section focuses on current issues of legal reform through critical views on criminal punishment, including observations on rape and hate speech. Each major essay describes the underlying principles in the development of a radical legal theory and addresses unresolved questions relating to it, while accompanying commentaries present conflicting views. The resulting dialogue explores wide-ranging issues like equity, value relativism, adversarial and empathic legal advocacy, communitarianism and the social contract, impartiality and contingency, "natural" law, and corrective justice. A common thread for many of the articles is a focus on the social dimension of society and law, which finds the individualism of prevailing liberal theories too limiting. Radical Critiques of the Law is particularly unique in presenting critical and feminist approaches in one volume-along with skeptical commentary about just how radical some critiques really are. This paper is one of the four interrelated action agenda papers resulting from the National Summit on Public Health Legal Preparedness convened in June 2007 by the Centers for Disease Control and Prevention and multi-disciplinary partners. Each of the action agenda papers deals with one of the four core elements of legal preparedness: laws and legal authorities; competency in using those laws; coordination of law-based public health actions; and information. Options presented in this paper are for consideration by policymakers and (...) practitioners — in all jurisdictions and all relevant sectors and disciplines — with responsibilities for all-hazards emergency preparedness.One expert's framing of the mission of public health may help improve understanding of the range of hazards for which to be legally prepared. These hazards include urgent realities — such as chronic disease, injury, disabilities, conventional communicable diseases, and an aging and obese population — and urgent threats, such as pandemic influenza, natural disasters, and terrorism.
